STANDARD TERMS AND CONDITIONS OF SALE



1. PRICE

1.2 Unless specified to the contrary, any prices quoted are in Jamaican dollars and are exclusive of any taxes, fees, duties or the like. Unless otherwise stated, the Price does not include the cost of loading, transportation and transit insurance of the Equipment, which shall be the responsibility of the Customer.

1.3 If the Price is expressed to be exclusive of GCT, the Customer will pay, in addition to the Price, the amount of GCT which is payable to CESCO  in respect of the Equipment.


2. DELIVERY

2.1 If delivery is delayed as a result of circumstances which are outside of CESCO’s reasonable control, the Delivery Date will be extended for the period of the delay.

2.2 The Customer must accept and pay for any Equipment supplied by CESCO notwithstanding minor inaccuracies in the precise quantity, quality, size, weight, functionality or description of the Equipment.

2.3 Except if the Equipment is to be installed by CESCO, risk in the Equipment will pass from CESCO to the Customer upon completion of loading of the Equipment for transportation from CESCO’s premises.

2.4 The liability of risk or loss is transferred to the customer upon delivery of the products to site. CESCO’s delivery dates are estimates only and reserves the right to make partial shipments and customer will accept delivery and pay for the products delivered.

2.4 A delayed delivery of any part of an order does not entitle customer to cancel other deliveries. CESCO LTD is not liable for failure to fulfil its obligations for and accepted order or delays in delivery due to causes beyond reasonable control, (for example, acts of God, acts or omissions of the customer, man-made or natural disasters, epidemic medical crises, material shortages or delays in transportation.


3. RETURNS & REFUNDS

3.1 All returns are subject to a 10% re-stocking charge except in the case of an error or defect on the part of CESCO Ltd.

3.2 Goods must be returned with the original invoice within 5 days of the delivery date, and must be unused, un-installed and in it’s original packaging.

3.3 We do not accept returns for bulbs, tubes, fuses, ballasts, cut wires, relays, contactors, starters or electronic equipment.


4. PAYMENTS

4.1 If the payment terms of this agreement require payment prior to delivery of the item(s) and where CESCO has advised the customer that CESCO is able to deliver the item(s) ordered, the customer shall pay to CESCO the balance purchase price within thirty (30) days of being so notified.

4.2 In the event that the customer does not pay the balance purchase price within the said thirty (30) days, CESCO shall be entitled to cancel the agreement with the customer by notice in writing, and the customer will forfeit their deposit.

4.3 Thereafter CESCO shall be entitled to re-sell the item(s) and shall not be liable to account to the customer for any part of the proceeds of such re-sale. The delivery date stated is only a guide, and whilst CESCO will endeavor to meet such a date, it shall not be binding.

4.4 A deposit towards a quotation confirms that the client has accepted the terms and conditions of Cesco Ltd.


5. SPECIAL ORDERS

5.1 Special orders for non-stock or custom fabricated items are not subject to cancellation except at the option of the vendor and hence deposits on such special orders are non-refundable and non-transferable.
